Terms of Service

1. About the Service

Lofi-Kawaii is a small music-player Activity that runs inside Discord. It provides background music playback, track selection, playback controls, volume control, and visual effects. Playback is local to each participant's device; Lofi-Kawaii does not promise synchronized playback between participants.

2. Eligibility and Discord Rules

You may use Lofi-Kawaii only if you are permitted to use Discord and meet Discord's minimum age requirements in your country. You must comply with applicable law, the Discord Terms of Service, and the Discord Community Guidelines while using the Activity.

3. Acceptable Use

You must not:

• use the Activity for unlawful, harmful, deceptive, or abusive purposes;
• interfere with, overload, disrupt, or attempt to bypass the security of the Activity or Discord;
• use automated means to scrape, probe, or misuse the Activity;
• misrepresent your relationship with KMC Apps, Lofi-Kawaii, or Discord; or
• use the Activity in a way that infringes another person's intellectual property, privacy, or other rights.

4. Content and Intellectual Property

The Activity's software, interface, artwork, audio, names, and other materials are owned by KMC Apps or made available under licenses or permissions held by KMC Apps. Some materials may be subject to separate open-source, public-domain, or third-party notices supplied with the Activity. These Terms do not transfer ownership of any content to you. You may use the content only as part of the normal operation of the Activity unless a separate notice expressly allows additional use.

5. Changes, Availability, and Termination

KMC Apps may update, replace, suspend, or discontinue features or content, including available music, at any time. The Activity may be unavailable because of maintenance, hosting failures, Discord changes, network conditions, or other circumstances. KMC Apps may restrict access where reasonably necessary to protect the Activity, users, or third parties, or to comply with law or platform requirements.

6. No Warranty

To the extent permitted by applicable law, Lofi-Kawaii is provided “as is” and “as available.” KMC Apps does not guarantee uninterrupted operation, error-free playback, continued availability of any track, compatibility with every device, or fitness for a particular purpose. Nothing in these Terms excludes warranties that cannot legally be excluded.

7. Limitation of Liability

To the extent permitted by applicable law, KMC Apps will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or use arising from the Activity. Any liability that cannot legally be excluded or limited remains unaffected.

8. Relationship with Discord

Lofi-Kawaii is an independent third-party Activity. Discord Inc. does not own, operate, sponsor, or assume responsibility for Lofi-Kawaii. These Terms are between you and KMC Apps and do not replace or modify your agreement with Discord.

9. Changes to These Terms

KMC Apps may update these Terms when the Activity, its content, platform requirements, or applicable obligations change. The effective date above will be revised when changes are published. Continued use after an update means that the updated Terms apply, to the extent permitted by law.
